FORTRESS21 – TERMS OF SERVICE

1. Introduction

These terms and conditions ("Terms") govern your use of the services provided by Fortress21 ("we," "us," or "our"), a company registered in Hong Kong. By booking a consultation or purchasing a service package, you ("the Client") agree to be bound by these Terms.

2. Nature of Services & Regulatory Disclaimer

2.1. Technical Consultancy Only: Fortress21 provides technical guidance, security architecture design, and educational services regarding Digital Asset Sovereignty.

2.2. Non-Custodial Environment: We operate on a strictly Digital Asset Sovereignty basis. At no time does Fortress21 have access to, possession of, or control over Client Access Credentials, Master Recovery Keys, or assets.

2.3. No Asset Sales or Brokerage: Fortress21 is not a Digital Asset Third-Party-Platform, broker, Over-the-Counter (OTC) desk, or remittance agent. We do not sell, trade, issue, or liquidate Digital Assets or any other Private Cryptographic Keys.

2.4. No Technical Procedures on Behalf: We do not execute Technical Procedures on behalf of the Client. All Technical Procedures (including outbound transfers, transfers, and acquisitions) are physically executed solely by the Client. Our role is strictly limited to providing technical instruction on how to execute these actions securely.

2.5. No Financial Advice: We are security architects, not licensed financial professionals or asset managers. Nothing in our services or communications constitutes investment advice, financial planning, or a recommendation to buy or sell specific assets.

3. Client Responsibilities

3.1. Accuracy of Information: You agree to provide accurate information regarding your architecture where necessary for assessment.

3.2. Final Execution: You acknowledge that while we provide guidance (e.g., "click here," "write this down"), the physical execution of Technical Procedures and Access Credential generation is performed solely by you.

3.3. Security of Environment: You are responsible for ensuring your physical environment is secure during consultations (e.g., no unauthorized persons listening).

4. Limitation of Liability (Read Carefully)

4.1. No Guarantee of Safety: While we employ institutional-grade best practices, the nature of digital security means risk can never be eliminated entirely. We do not guarantee that your assets are immune to theft, loss, or compromise.

4.2. Exclusion of Liability: To the fullest extent permitted by Hong Kong law, Fortress21 shall not be liable for any direct, indirect, incidental, or consequential loss of assets, data, or hardware arising from: (a) User error (e.g., losing a Master Recovery Key, sending assets to a wrong destination identifier); (b) Third-Party-Platform hardware or software failure (e.g., Ledger/Trezor bugs, Third-Party-Platform collapses); (c) Physical coercion or theft affecting the Client.

4.3. Cap on Liability: Our total liability for any claim arising out of these Terms shall not exceed the total fees paid by the Client to Fortress21 for the specific service in question.

4.4. Force Majeure: Fortress21 shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, typhoons (Signal 8 or higher), war, internet service provider failures, denial-of-service attacks, or failure of third-party communication tools (e.g., Zoom, Signal, Cal.com).

5. Payments and Refunds

5.1. Payment: Full payment is required to confirm a booking. We accept Digital Assets (via our self-hosted, non-custodial payment gateway) and fiat currency.

5.2. Refund Policy: (a) Cancellations: You may cancel a session for a full refund up to 24 hours before the scheduled time. (b) Services Rendered: Once a consultation session has commenced, the fee is non-refundable. (c) Package Upgrades: Credits applied from "Architecture Assessment" packages to "Architecture Implementation" packages are valid only if the upgrade occurs within 30 days.

5.3. Right to Terminate: Fortress21 reserves the right to terminate this agreement immediately and without refund if the Client: (a) Engages in abusive or threatening behavior toward our staff; (b) Requests assistance with illegal activities (e.g., money laundering, tax evasion); (c) Refuses to follow critical security safety protocols during the session.

6. Confidentiality

We agree to keep all Client information strictly confidential. We will not disclose your identity or the details of your architecture to any third party unless compelled by a valid court order from a competent Hong Kong authority.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

8. Intellectual Property & License

8.1. Proprietary Materials: All guides, diagrams, "Continuity Protocols," and educational materials provided to you during the engagement are the intellectual property of Fortress21.

8.2. Personal License: You are granted a non-exclusive, non-transferable license to use these materials for your personal security only.

8.3. No Resale: You agree not to reproduce, distribute, resell, or publicly display our proprietary materials without our prior written consent.
